Mediation

Pronounced: ah-rah-boo-loo-joo-LOOK

A structured negotiation before a registered mediator which, for several categories of dispute, must be attempted before a court case can be filed.

What it means for you

For certain commercial, labour and consumer claims mediation is a precondition to suing: file without it and the case is rejected on procedural grounds. It is usually fast, and a settlement reached there can be enforceable.

Commonly confused with

Mediation is not arbitration. A mediator helps the parties reach their own agreement; an arbitrator decides the dispute.
