İstinaf

Appeal to the regional court of appeal

Pronounced: is-tee-NAHF

The first level of appeal in Türkiye, heard by a regional court of justice that can review both the facts and the law.

What it means for you

This is a genuine second look, not just a legality check — the appeal court can re-examine the evidence. It sits between the first-instance court and the Court of Cassation, and it has its own filing deadline running from service of the judgment.

Commonly confused with

Temyiz is the next stage after istinaf, before the Court of Cassation, and it is narrower — mainly a review of the law rather than the facts.

In every litigation timetable; and in the reason a "final" first-instance win is not yet final.
